Пътниците на закъснели полети могат да имат право на обезщетение

Съдът на Европейските общности постанови, че пътниците на закъснели полети могат да имат право на обезщетение. Когато достигат крайния пункт на пристигане три часа или повече след времето по разписание, пътниците на закъснели полети, също както пътниците на отменени полети, могат да искат от авиокомпанията да заплати фиксираното обезщетение, освен ако закъснението не е причинено от извънредни обстоятелства.
Съдът определя, че технически проблем със самолет не могат да се считат за извънредно обстоятелство, освен ако тези проблеми произтичат от събития, които поради своето естество или произход не са присъщи на нормалното упражняване на дейността на съответната авиокомпания и се намират извън ефективния и контрол.
Регламентът предвижда, че при отмяна на полет пътниците могат да получат фиксирано обезщетение в размер между 250 и 600 EUR. Що се отнася до правото на обезщетение, предвидено в регламента в полза на пътниците на отменени полети, Съдът установява, че засегнатите от закъснение пътници претърпяват аналогична вреда, състояща се в загуба на време, и поради това се намират в сходно положение. Всъщност пътниците на отменени малко преди излитането полети имат право на обезщетение дори когато са премаршрутирани от авиокомпанията с друг полет, при положение че са загубили три часа или повече спрямо предварително планираната продължителност. Не би било обосновано пътниците на закъснели полети да бъдат след предварително планираното време за пристигане по разписание...
